Customized Hypno-Coaching CD
Service
Client Agreement
This Agreement between Motivational Strategies,
Incorporated and ___________________________________________________
(the Client) stipulates the requirements for the
Client’s participation in Motivational Strategies,
Incorporated’s Hypno-Coaching Customized
CD service. The Client and Motivational Strategies,
Incorporated agree as follows:
1. Nature of the Service
The Motivational Strategies, Incorporated Hypno-Coaching
Customized CD service is a service for self-improvement.
The service consists of a 50-60 minute interview
with the client, and the production of a customized
CD, based on information obtained during the interview.
A representative of Motivational Strategies Inc.
will conduct a single (1) interview with the Client,
and based on that interview, Dr. Judith Pearson,
a certified hypnotherapist, will record a customized
hypnosis CD. The interview and CD will focus on
the Clients’ desires and plans for one area
of self-improvement or enhanced skill. Examples
of areas for improvement or enhanced skill could
include: coping skills, self-confidence, sports
performance, pain management, stage performance,
academic skills, interpersonal skills, or behaviors
related to time management, personal health, concentration,
relaxation, or motivation. The CD will be mailed
to the Client within three weeks following the
interview. Motivational Strategies, Inc. accepts
only Mastercard or Visa as payment of this service.
Our services are available only in English.
The entire cost of the service is $250. The fee
covers the single 50 to 60 minute interview, and
recording, production, labeling, shipping and
handling for the CD. Once received by mail, the
CD becomes the property of the Client. Notes from
the interview will remain in the possession of
Motivational Strategies, Incorporated for a period
of one year, at which time those notes will be
destroyed by shredding.
This service is NOT intended
to treat mental health problems or psychiatric
concerns. This service is NOT
intended to provide legal, financial, or medical
advice. This service does NOT
include age regression, recovery of memories,
or past life regression. This service is NOT
intended as a cure or remedy for any disease,
illness, or ailment, nor as a substitute or replacement
for appropriate medical, mental health, or psychiatric
intervention.
Motivational Strategies, Incorporated reserves
the right to refuse this service to anyone, particularly
if Motivational Strategies, Incorporated considers
this service to be inappropriate for any given
individual or if that the Client’s stated
intended result is beyond the scope of the service
offered. Motivational Strategies, Incorporated
will not, however, discriminate against any individual
on the basis of race, religious affiliation, gender,
nationality, physical disability, or ethnic background.
2. Guarantees and Disclaimers
The Client’s interview will be conducted
by a qualified staff member and the voice on the
CD will be that of Dr. Judith Pearson, a certified
clinical hypnotherapist and licensed professional
counselor. Dr. Pearson’s credentials are
available upon request or by checking the web
site www.engagethepower.com. Motivational Strategies
will render ethical, competent services to each
client, within the limits of professional knowledge
and training.
Motivational Strategies, Incorporated will safeguard
the Client’s confidentiality and privacy.
Neither the information obtained from the interview,
nor the client’s identifying information,
nor credit card information will be shared with
any third party.
Motivational Strategies, Incorporated guarantees
that the CD sent to the Client is the one that
is customized for that Client. The CD will be
mailed within three weeks of the interview. If
the Client doesn’t receive the CD within
three weeks, and notifies Motivational Strategies,
Incorporated that the CD did not arrive, Motivational
Strategies, Incorporated will send a second copy
of the CD.
All sales are final. While the CD will NOT
have the sound quality of a studio-produced CD,
Motivational Strategies Inc. guarantees that it
will be free of flaws such as skips, scratches,
or lost content. Should the Client receive a broken
CD or a CD with faulty recording, the Client should
notify Motivational Strategies, Inc. within 30
days of receipt and Motivational will send a second
copy of the CD at no charge.
The CD that the Client receives will not contain
any subliminal content, nor any profanity. Motivational
Strategies will refuse requests for content that
is, in our judgment, immoral, obscene, bigoted
or defamatory. Every CD will include recorded
instructions within the narrative that the Client
is free to accept or reject any suggestions therein
and that all appropriate, helpful suggestions
will be implemented in a safe and healthy manner.
Individuals vary as to hypnotizability. Some
individuals cannot be hypnotized, some can be
hypnotized to a degree, some can be hypnotized
and still not comply with suggestions, and some
can achieve results only after repeated exposure
to hypnotic instructions. Additionally, hypnotizability
can be influenced by many factors including the
client’s personality, motivation, mood,
and health. Therefore, Motivational Strategies,
Incorporated does NOT guarantee
that, upon listening to the CD, the Client will
experience hypnotic trance, or the degree of hypnotic
trance that the Client will achieve.
MOTAVATIONAL STRATEGIES, INCORPORATED DOES NOT
GUARANTEE SPECIFIC RESULTS FOR ANY INDIVIDUAL
CLIENT. Hypnosis is not an exact science and results
can vary among individuals. Some people are more
responsive to hypnosis than are others. The Client
is ultimately responsible for his or her own decisions,
actions, choices, and emotions, during and after
any form of hypnosis.
3. The Client Must Represent Self
The Client agrees that he or she will not misrepresent
his or her identity to Motivational Strategies,
Incorporated in any way. The identification information
(name, address, and phone number) that the client
supplies Motivational Strategies, Incorporated
is accurate, to the best of his or her knowledge.
The Client agrees that the credit card he or she
uses belongs to him/her or that he or she is using
that credit card with permission from the owner
of the card.
4. The Client must be of Legal Age or
have Parental Permission
All clients participating in the Motivational
Strategies, Incorporated Hypno-Coaching Customized
CD service, must be of legal age of majority in
the state in which they reside, or must have the
written, signed permission of a parent or legal
guardian to participate in the service. Motivational
Strategies, Incorporated will supply a permission
form, as needed, for parental or guardian signature.
The signed form must be returned to Motivational
Strategies, Incorporated prior to the interview.
5. Use of Audio Recordings
The CD will include instructions for relaxation.
Therefore, the Client agrees that he or she will
not listen to the recording in a moving vehicle,
or when operating potentially dangerous equipment.
The Client will not reproduce the CD recording
for commercial purpose or financial gain. Audio
recordings produced by Motivational Strategies,
Incorporated are for the Client’s personal
use. If the Client allows others to listen to
an audio recording produced by Motivational Strategies,
Inc., then Motivational Strategies, Inc. is in
no way responsible for outcomes or results, since
Motivational Strategies, Inc. has not entered
into a service contract with any other users or
listeners.
